Meeting With Your Attorney

The first step towards debt relief through bankruptcy is calling the Law Offices of Morgan & Morgan by phone at (706) 548-7070, toll-free at (800) 924-7438, or by clicking the contact button. You will set an appointment time for a free consultation with an attorney. Before your first appointment, click on the "New Client Forms" button on our homepage. Either submit the forms electronically, or download and print a copy to bring with you. This information will be used by your attorney to discuss your best options moving forward.

Credit Counseling Course One

The next step in your bankruptcy filing involves completing the first of two state mandated credit counseling sessions. After meeting with your attorney, you will complete the first credit counseling session by going to their website at www.cccs-express.org or by calling (866) 445-2227. The cost of completing the courses is $50 per session or $100 total. The first credit counseling course takes approximately 30 to 45 minutes, during which you will supply your personal contact information, your debts and their current balance, and your income and expenses for a month. Once your first credit counseling course is completed, you will continue to the next step: Meeting with your paralegal.

Meeting with Your Paralegal

Now that your first credit counseling course is complete, you will come back to our offices and meet with one of our three paralegals. You will need to bring some different documents with you for this meeting. First, you will need copies of any pay-stubs received in the last 6 months. Second, you will need copies of your most recent property tax statements. Third, bring copies of your federal and state tax returns for the last 2 years. Fourth, you will need a copy of your most recent bank account statement showing a positive balance. Finally, you will need a copy of your credit report. Go to www.annualcreditreport.com to obtain a free copy. When you come for this appointment, your paralegal will gather all of this information and file your case. You will need to pay the appropriate filing fees at this time.

Meeting of the Creditors

The next step is the meeting of creditors, also known as a "341
meeting". During this meeting, the trustee will verify the debts
and assets listed on the bankruptcy petition prepared by your
lawyer. During this process, you should not make new charges to
credit cards, or open new debt. Your assets will either be entirely
liquidated and your debts eliminated in a Chapter 7 bankruptcy
plan, or a repayment plan will be established in a Chapter 13
bankruptcy plan. Creditors will have up to 60 days to dispute
discharging any or all of your debt. If no creditors dispute, you
debt will be discharged. In a Chapter 7 bankruptcy your debt is
discharged almost immediately, while a Chapter 13 bankruptcy is not
fully discharged until the completion of your payment plan.

Credit Counseling Course Two

Thenext step in your bankruptcy filing involves completing the second oftwo state mandated credit counseling sessions. Now that your case has been filed, you will complete the second credit counseling session by going to their website at www.cccs-express.org or by calling (866) 445-2227. The cost of completing the courses is $50 per session or $100 total. The second credit counseling course takes approximately 2 hours, during which you will read 8 chapters followed by 4 question multiple choice exams. The second credit counseling course will give you valuable advice to help you handle your finances moving forward.
